STRAVA Challenge and Competition - Terms & Conditions

Promotor and organizer

The promoters and organizers of the challenge and prize competition are 361˚ Europe, with the Dutch Chamber of Commerce number: 66674999 and registered seat at Fanny Blankers-Koenplein 50 2031 VW Haarlem The Netherlands and Strava, Inc. (“Strava”) with its address at 208 Utah Street, San Francisco, CA 94103, USA, operating the website and providing a service to record and track activities on http://www.strava.com (the “STRAVA Application” or “Service”).

The Challenge

361˚ Europe’s  ‘ENGAGE with 361˚’ challenge (the “Challenge”) is for STRAVA Application users to complete 5KM of Hike, Run, Walk, Virtual Run or Wheelchair recorded activity within the Challenge Period.

Duration of the STRAVA challenge

The Challenge will start on the 1st January 2023, 00.01am GMT +1 and ends on the 14th January 2023, 23.59pm GMT +1 (“Challenge Period”).

The Competition

Subject to these terms and conditions, eligible participants who complete the Challenge within the Challenge Period will go into a prize draw to win one of the following rewards:

-          361˚ Goody Bag.

-          361˚ Apparel, including caps and beanies.

-          New 361˚ Centauri running shoes (20 pairs up for grabs).

-          Entry for you and a friend into one of 361˚’s sponsored events, Palma Marathon 2023! This also includes travel and accommodation for the event. Two separate winners will be announced.

Eligibility for participation in the Challenge

The Challenge is eligible to residents of any country in which STRAVA Application is available. However, the participation in the Competition and prize draw is limited to residents of certain countries only (as specified below).

The Challenge will be available and promoted only to residents with an open STRAVA application account. Participants domiciled in other jurisdictions will not be able to access the Challenge in the STRAVA application but will still be entitled to participate in the prize competition through profiles of other individuals that have a STRAVA account and are domiciled in the jurisdictions set forth in this paragraph.

The Challenge is open to “STRAVA” users aged at least the legal age required in their jurisdictions of domicile to participate in online games of chance. Any employees of 361˚ Europe or employees of 361˚ authorized distributors, members of the immediate families or households of these employees, and anyone otherwise connected with the organization of 361˚ and/or the STRAVA Application are not allowed to participate in this contest. 361˚ reserves the right to systematically exclude these participants.

By entering the Challenge, each participant confirms that they are eligible to do so. If a participant is not of the required minimum legal age, 361˚ Europe/Strava reserve the right to exclude that individual from the Challenge.

If such a circumstance is confirmed after the individual who is not of the required minimum legal age has already won a prize in the competition, 361˚ Europe/Strava may deny awarding this individual with the prize and delegate the prize to another participant within the rules of the draw.

People under the minimum age limit may access the content of the Challenge, but no information will be requested from them and no prize will be awarded.

There is no entry fee and no purchase necessary to enter the Competition and the winners will not be liable for any costs related to shipping. 361˚ Europe/Strava will not be liable for any third-party costs incurred by participants (such as any costs that might be incurred to access the internet) as a result of entering the contest. 361˚ also will not be liable for any fiscal/tax obligations that the winners of the Competition could be subjected to in their local jurisdictions as a result of claiming the prizes.

Prize Information

Between all participants that completed the Challenge successfully during the Challenge Period and are eligible to take part in the Competition and prize draw, winners will be chosen by random draw performed by a computer process within 4 weeks after the end of the Challenge. However, depending on the prize, the delivery of the prizes to the winners can take up to 3 months.

All winners will be notified by email or telephone (using details provided at entry) within 4 weeks and must provide a postal address to claim their prize. The prize is non-exchangeable, non-transferable and no cash alternative is offered. The promoter/organizer reserves the right to replace the prize with an alternative prize of equal or higher value if circumstances beyond the promoter’s/organizer’s control makes it necessary to do so. The decision of the promoter/organizer regarding any aspect of the prize draw or competition is final and binding and no correspondence will be entered into about it.

The promoter/organizer reserves the right to hold void, cancel, suspend, or amend the promotion where it becomes necessary to do so. The promoter/organizer reserves the right to publish the name, photograph, likeness and county of the winner or to publicize the Competition or the prize-giving presentation, in any and all media that the promoter/organizer desires, after the date of the Competition close date and within a year of this date. The winner agrees to take part in such reasonable Competition-related publicity as the promoter/organizer may require and accepts that the promoter/organizer may publicize images/statements in connection with/resulting from this Competition. Prizes are non-transferable and cannot be resold or exchanged for cash.

Eligibility to participate in the Competition and prize draw

The Competition amongst the participants of the Challenge is only open to all STRAVA Application users that are at least the minimum legal age required in their jurisdictions of domicile to participate in online games of chance and are residing in one of the following countries: Switzerland, Germany, Austria, France, Spain, Italy, UK, Ireland, Luxembourg, Sweden, Denmark, Netherlands, Cyprus. Residents of other countries are not entitled to take part in the Competition and prize draw.

Employees of 361˚ Europe and/or Strava and their immediate families, their agents and anyone professionally connected are excluded from the Competition.

Entry to the Competition is available upon use of STRAVA Application/Service only. Manual entries, or rides marked ‘Private’ will not count towards your challenge effort.

All activities logged during the Challenge period must be uploaded to Strava no later than three days after the Challenge ends. In order to participate in the Competition and prize draw, no purchase is necessary.

All entries must be made directly by the person entering the Challenge and Competition. Entrants who do not give correct details will be disqualified at 361˚ Europe/Strava’s discretion.

No responsibility will be taken by 361˚ Europe/Strava for entries or claims which for technical or other reasons are not entered correctly or are lost. Incomplete entries will not qualify for the Challenge and Competition.

After successfully completing the Challenge, participants will receive an email with further information and a link to a subscription page, on which the participants will need to register and accept the terms and conditions of the Competition in order to participate in the prize draw.

Furthermore, all participants will be required

  • to provide consent to 361˚ Europe and/or Strava for processing their personal data that is needed for the users participation in the draw,

 

  • to subscribe to a newsletter and commercial communication of 361˚ Europe,

 

  • to provide consent to 361˚ Europe for the use of their personal date to publicize the prize award in case they will be awarded with a prize.

Limitation of liability

Insofar as is permitted by law, the promoter/organizer, its agents or distributors will not in any circumstances be responsible or liable to compensate the winner or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the prize except where it is caused by the negligence of the promoter/organizer, its agents or distributors or that of their employees. Your statutory rights are not affected.

Miscellaneous

The promoter/organizer and its agents reserve the right at its sole discretion not to consider, and to exclude or disqualify any entry that they deem to be abusing or tampering with the operation of the Competition, or to be acting in any manner deemed by the promoter/organizer to be in violation of or inappropriate with these terms and conditions.

The promoter/organizer reserves the right to verify all entries including but not limited to asking for address and identity details and to refuse to award a prize or withdraw prize entitlement and/or refuse further participation in the Competition and disqualify the entrant where there are reasonable grounds to believe there has been a breach of these terms and conditions or any instructions forming part of this Competitions entry requirements or otherwise where an entrant has gained unfair advantage in participating in the Competition or won using fraudulent means. The promoter/organizer will be the final arbiter in any decision and these will be binding and no correspondence will be entered into in relation this clause.

The Competition is not sponsored, administered or endorsed by, or associated with, Facebook, Twitter or any other Social Network or the producers, retailers or any other party featured in the prizes. Trademarks, logos and names of any third party are the property of their respective owner.

The promoter/organizer assumes no responsibility for: (i) any error, omission, interruption, or delay in the operation or transmission of any communication sent to (or by) the promoter/organizer or any entrant whether caused by problems with communication networks or lines, computer systems, software or internet service providers, congestion on any carrier network or otherwise, (ii) any theft, destruction or unauthorized access to, or alteration of such communications; (iii) any problem with, or technical malfunction of, any computer system or other equipment used for the conduct of the Competition; (iv) any incorrect or incomplete information which may be communicated in the course of the administering this Competition (whether as a result of one of the foregoing causes or otherwise); (v) any delay in delivery, or failure of safe delivery of the prize.

In the event of circumstances outside the reasonable control of the promoter/organizer, or otherwise where fraud, abuse, and/or an error (human or computer) affects or could affect the proper operation of this Competition or the awarding of prizes, the promoter/organizer reserves the right to cancel or amend the Competition or these terms and conditions, at any stage, but will always endeavor to minimize the effect to entrants in order to avoid undue disappointment.

To the full extent permitted by law and excluding death or personal injury caused as a result of the promoter/organizer’s negligence, the promoter/organizer, its associated companies and agencies and any of their personnel (the "Relevant Parties") exclude all liability for any loss (including any damage, claim, injury, cost or expense) which is suffered or incurred by any entrant in connection with the Competition or prize, including without limitation: (i) any indirect, economic or consequential loss; (ii) any loss arising from the negligence of a Relevant Party; (iii) any liability for personal injury or death.

The Competition and the terms and conditions will be governed by Dutch law and any dispute arising out of or in connection with the Competition will be subject to the exclusive jurisdiction of the courts of The Netherlands.

Promotion

The Challenge and Competition will be promoted on the 361˚ Europe website, 361˚ Europe social media, by email communication to 361˚ Europe clients and by certain “361˚ Europe” Athletes that are under a sponsorship agreement with 361˚ Europe.

Terms & Conditions

By entering the Competition, all entrants will be deemed to have accepted and be bound by the terms and conditions and all entry instructions form part of these terms and conditions. These terms and conditions prevail in the event of any conflict or inconsistency with any other communications, including advertising or promotional materials.

Personal Data

  • Any personal information provided by entrants residing in the European Economic Area will be collected, stored and processed by or on behalf of the promoter/organizer strictly under the General Protection Data Regulation (2018). The promoter/organizer/ will make sure any kind of consent from participants is given freely, that consent to process personal data is specific and distinguishable from other matters, that participants will provide an informed consent, all in an unambiguous manner in plain language. Participants will always have the right to revoke their provided consent to process personal data.
    1. The promoter/organizer clearly states that participation in the Competition and the participants consent to personal data processing is not conditioned on any kind of purchase of 361˚ Europe /Strava products or services.
  • The promoter/organizer will acquire separate (“granular”) consent for personal data processing needed to administrate the Competition, for personal data needed for the participant to subscribe to a newsletter and other promotional materials of the promoter/organizer and personal data needed to award and publicize the winners of the Competition.
    1. Participants will be obligated to provide suitable consent to receiving the promoter’s/organizer’s newsletter and other promotional material as a prerequisite for participation in the draw. Further information about the newsletter, in particular how a participant can assert his/her right of revocation of general rights of data subjects, can be found online in 361˚ Europe’s Data Privacy Policy (https://361europe.com/policies/privacy-policy).
  • An entrant’s personal details may be used for the marketing purposes of the promoter/organizer only if an entrant has opted in to receiving future marketing mailings from the promoter/organizer or for any other purpose agreed by an entrant. If an entrant would like to stop receiving messages from the promoter, he/she can use the unsubscribe button provided in an email from the promoter.
  • Other than its agencies and third-party suppliers who are contracted to administer the Competition, the promoter/organizer will not pass entrant’s details on to any third party unless otherwise required to do so by law.
